CONTRACTOR TERMS & CONDITIONS
By confirming these terms all contractors, whether CIS Self employed, Limited Company or PAYE Umbrella Contractors (Hereafter “the Contractor”) accepts, agrees and understands the basis on which Pinpoint Solutions Contracting Limited, as an Employment Intermediary ONLY, will seek to find them suitable work .
The Contractor CONFIRMS THAT they;
1. Are suitably qualified and experienced to undertake the type of work/role that they have applied for on the Pinpoint Solutions Contracting Limited (Hereafter “Pinpoint”) Registration Form and able to both provide copies of the appropriate evidence as required, including professional certificates, to both Pinpoint and the end client (Hereafter the “Hirer”) before commencement of the Contract;
2. Are responsible for ensuring a timesheet is signed by the Hirer confirming both the hours of work and that the work has been carried out to a satisfactory standard;
3. Authorise Pinpoint to deduct or set off fees due to HMRC, (which includes salary and other remuneration of the Contractor) and hereby authorise Pinpoint to deduct or otherwise set off from the salary, and or any other remuneration or payment, to the Contractor and sums properly due to Pinpoint, including but not limited to; a) payment for the services performed under the assignment which Pinpoint is satisfied have not been performed to the standard required by the Hirer or b) in respect of any damages, losses, claims, expense costs, fines, penalties and/or any other liability suffered by Pinpoint and or the Hirer arising under or in connections with any breach by the individual of the terms of this Agreement, or arising from any act, error, omission, statement or misrepresentation of the Contractor in the performance of the Assignment or c) any liability arising under any indemnity in this agreement;
4. Have read and understood Pinpoints Data Protection Policy and GDPR statement which is on our website and allow Pinpoint to hold their details in electronic and other form for this assignment and for potential future work. Also to allow Pinpoint to pass on such personal information to i) other organisations for the purpose of securing potential future work for the Contractor, and ii) as directed by lawful authorities;
5. Agree that no claim, in whatever form, will be made against Pinpoint for loss of remuneration or salary if; i) the Hirer fails to request any specific hours from the Contractor on any day throughout the length of the assignment, or if, at the Hirer’s or Pinpoint’s discretion, worked is delayed, cancelled, postponed or otherwise changed for whatever reason at any time or ii) the assignment is cancelled at any time before or during the assignment for whatever reason. For avoidance of doubt this includes ‘last minute’ or ‘on the day’ cancellation even when/if the Contractor has arrived on site;
6. Accept that Pinpoint will pay the Contractor into the nominated bank account of the Contractor within one week of receiving a signed (including electronically signed) timesheet from the client and further understands that in the absence of a signed timesheet from the client payment may be delayed until such time that one has been received. Agrees to provide us with an up to date email address to which to send both remittance advices and CIS/PAYE deduction statements as Pinpoint is required to do by law;
7. Understand that to fulfil its obligation under section 6 above Pinpoint may use a third party payroll agency/umbrella company as the end employer for PAYE (non CIS) roles, which will incur fees for the contractor, normally known as a “payroll fee”. The Contractor understand that they can nominate a payroll provider of their own choice. In doing so they accept any fees charged by that payroll provider and exempt Pinpoint from any payroll fee or expense arising from it. In the event that a third party payroll company is not used Pinpoint may charge its own payroll fee for providing these services;
8. Accept that in agreeing to be employed OR receive payment through a third party payroll agency that the contractor will be required to both register with and agree the payroll/umbrella company’s terms and conditions, and;
9. Agree to comply with the Hirer’s site policies, attend induction sessions and comply with all site HEALTH & SAFETY requirements, including wearing appropriate Personal Protection Equipment at all times.
CIS SELF EMPLOYED & LIMITED COMPANY CONTRACTORS ONLY
IN ADDITION TO THE ABOVE CIS Self Employed/Limited Company CONFIRM that;
10. If applying for a CIS self employed role they have given a complete and unreserved assurance, and provided to Pinpoint appropriate documentation, that they are a genuinely self employed contractor under the UK legal definition in place at the time of taking any assignment and to inform Pinpoint immediately if this status changes in whatever form and at whatever time;
11. Authorise Pinpoint, or a third party operating on behalf of Pinpoint, to carry out CIS checks via the HMRC to identify verify the appropriate deductions for the contractor;
12. Are completely and singularly responsible to pay any other taxes, National Insurance contributions or any other liabilities in relation to their personal obligations arising from salary, or any other remuneration in whatever form, that arises as a result of this assignment;
13. Will undertake to indemnify and keep indemnified Pinpoint against any business costs, claims or liabilities arising out of failure by The Contractor, to meet any of their obligations in any of the clauses 1) to 12) above relating to any assignment;
14. Are liable for rectifying any faults or substandard work at their own expense and have appropriate and up to date public liability and indemnity insurance for all self employed roles;
